Why The IRS Can Take Your Refund

There is nothing worse than filing your taxes and expecting a sizable tax refund only to receive a letter that the government has seized the money. There are real reasons why the IRS can keep your money and you should know every one of them.

The tax filing season can be filled with stress and anticipation. For some people, that tax refund helps to pay bills or plan once a year family vacations. When the check is supposed to be in the mail and a letter of refund seizure from the IRS is the only thing to show up, the time has come to look back and find out what government debt was left unpaid.

The Student Loan Repayment Program

The Federal student loan program is directly linked to the IRS. If, at any time, the student loans you borrowed for college fall into default, the IRS has every legal right to take your income tax refunds until the time when all monies owed are paid in full. If the IRS took your refund check this year, try contacting your loan originator and setting up a payment plan to pull those loans out of default.

Unpaid Child Support

Another huge government debt is child support. The Federal agency that collects child support reports any unpaid child support to the IRS. When the taxpayers who owe unpaid child support file their tax refund, the IRS will seize the refund and send the proceeds to the child or children on file.

Unpaid Back Taxes

Some taxpayers file their federal taxes and never pay the amount owed to the government. When the taxpayer files and is due a tax refund, the IRS will keep all or a portion of that tax refund to cover the previous year's taxes. If the taxes owed are less than the refund for the current year, the taxpayer will receive a reduced refund.

Any Unpaid Federal or Government Debt

The student loan repayment program, child support program and unpaid back taxes are the three top reasons the IRS will keep a taxpayers refund check. However, this list is not all inclusive. Any unpaid Federal or governmental debt accrued before the tax refund may be paid off with the tax refund without prior notice to the taxpayer.

Last year I was married and filed a joint return. We owe the federal govt. I have divorced my husband soon after in 2010. This year (2011),  I will file as single- head of household. My ex husband has made arrangements with the IRS to pay the unpaid balance for 2010. Can the IRS still relinquish my refund for the year 2011?

how can i find paperwork on why the bank of america is getting my entire tax refund? they forclosed on me 3 years ago and since then they are recieving my entire refund, i have no paper work except where irs sends me that i will not recieve my refund.

Irs has delay my refund for up to 6 weeks I call they don't need any  info just they told me to wait 45 dated.  have you have any experience on that.

I just want to know since i am new to this . I am a full time student never been late on my payments . The question is i live in idaho and my oldest daugther live's in kentucky can the IRS take my taxes even through i am am file for my school loan's. I was just wanting to know if they can take my taxes for Child Support even through i haven't been late on my payments. Can someone please tell me if they can or not. Since i am so new to this .

I had that same question this year.  i fell behind on my student loan at the end of last year and have been a little slow at catching it up.  when i asked SallieMae about my private student loan, they said that if i was only a little behind, they wouldnt take my tax return.  i was told that it would have to go to a third party collection agency before they would take my return.  check with the bank the private loan is through.

Good luck with that! My husband over payed also getting to talk to anyone is non exsistant! They have sent us 2 checks worth a total of 100.00 and he over payed by a few thousand....

You will need to make an amendment on your taxes....Your tax preparer can tell you more just give them the 1099 from last year you shouldnt have any trouble

confused
I filed in january...still havent gotten my taxes back. everytime i call all they say is there is a delay and wait another 30 days. i wait the 30 days and call back..they say the exact same thing. i dont owe child support. i dont have student loans. i dont owe the government anything.

Student loan
My first paycheck with my new job is two weeks away. I do owe on student loans but have set up payment arrangements with a collection agency. Is two weeks enough time for the IRS to keep my money to pay on the loans?

Private Loan

It is my understanding that only federal student loans may cause you to forfeit your return to the IRS because it is directly funded by them; fortunately for you, your loans are private and not federally or state funded... your tax return is in the clear.... However, if the Private lender gets any kind of judgment to garnish; watch your pay checks and accounts!

Can they take every bit of what you actually got for the student loan or what you are behind on? I'm so confused about this.. I do know that last year they took all of my money but yet, I still owe 10,000 dollars. So Last year caught up on what I was behind on, and now, they when I call to make arrangements for paying the student loan ppl, they want paid in full.. It's only been 3 yrs and I'm jsut wondering. Well i filed my tax return an guess what instead of getting back the 5200.00 that i earned i only got back 720 dollars when i called there 1800-829-1040 number it tells me to wait one week then call back ? is this how the government does its hard to work citizens ? are you serious ? im better off on welfair !

getting a divorce settlement
Is there a way of collecting an $8000.00 divorce settlement by having the IRS intercept the money? This has nothing to do with child support. But it is a court ordered settlement on marital bills & property.

I owe a student loan but I recieve goverment assistance and I am a single mom of two. I lost my job and have no income at all so I depend on that refund to make it for a while. Cant our wonderful irs see that people are hurting right now? Of course not because they dont give a crap about anyone!!!!

Umemployment screwed me!
My husband called unemployment last year to ask why he did not recieve his 1099 from them. They told him that he was not in their computers and therefore did not recieve any payments from them (which he was gettin payment direct deposited form them every week) so that he did not have a 1099 form them. So, we went and filed our taxes without it. Some weeks later we got a 1099 in the mail from unemployment. Since it is their fault that it was not filed because they told him he did not have one, I dont think that they should be able to hold my taxes for it, what do you think? They haven't held them yet but.. they will at some point, as I am going to file this year and will be homeless without my federal refund, this scares me. WHAT DO YOU THINK?

hello my question is my student loan is on offset with irs and I called dcs officer and made a payment plan with him , applied for a rehab program to get if offset. If i do my refund will they garnish it even though i maked paid ment plan the orignal depter. I am not working right now living on unemployement wages. and i have a little one to mantain and feed. can you please tell me whats going to happen., or parial of the money will be taken, i am confused. please advice.

25 years later...
I have paid on this 1,500.00 on several occassions. they even garnished my wages. They took my tax refund, and then, This passed couple of months, They have threatened me and my husband. I asked what I owed AGAIN!!! and She couldn't tell me but with all that, She told me I have only paid 250.00 on this loan. I know they are LYING!!! They took my husbands refund, and I didn't marry him till almost 12 years after I made the loan. I was a single Mom on wellfare, and I was told it wouldn't be held against me, But again They Lied.

payment arrangement
i made arrangements to pay my food stamp overpayment which i am no longer receiving and have been paying. Today i received a letter stating that the irs can take my refund. Can they do that if im making payments? The letter was dated before i started making payments.

owe irs?
I just got a letter on jan. 3, 2011 saying i owe irs 4 grand. they sent me a 9465 Installment Agreement Request FORM to make monthly payments for 60 months. need to send it back by jan 26, 2011.
i am sending the form back today. will i still get a refund as long as i make monthly payments or will they just take my whole refund for the debt?

I owed the IRS one year and didn't pay and they took it out of the next year's refund and sent me the rest of my refund check. My question is: Will they do the same with back child support due? I am only in arrears of 14 hundred dollars and anticipate over 7,000 to be refunded. I don't want to lose all my income tax. I am in Texas.

Child Support
I receive child support for my son who was born in NYC but we now live in Va. I was told that the father had over paid taxes and I would be paid from the money when the IRS released the funds and the father would not have to pay child support from Oct/09 till 6/10. My son and I did not as of yet get the intercepted tax refund and just this June after 9 months started receiving child support. How do I find out where is the intercepted refund ($4,200). The child support office has been of no help.

irs taking my refund because of a debt owed from 1998. The ex husband was ordered to pay this in the divorce decree, and has not. The irs has taken my refunds since 2003 thru 2010. Statute of limitations should have been 2008. So can I get my money back that they took in the years 2009 and 2010?? Irs could care less what divorce papers say, and I am sure the ex new this when filing divorce papers, knowing good and well he was with no intention of ever paying it.

ok, so the irs has been taking my taxes for years on a situation where there were back taxes that my ex husband was ruled in court to pay. Well, the irs does not care about what the divorce papers say, and since he is not paying it, they have taken my returns for years! Original date was filed in 1998. I have paid every year since then, and now knowing there is a 10 year limit for them to collect it, can I get the money back somehow for the last 2 years (after the 10 yr limitation would have been). 2009 and 2010?? I am guessing they should not have taken that and I want it back. Any suggestions????

hello my question is my ex-has two childsubport cases , mines and another women. for the past two years irs has taken his tax return and gave all to the other childs case. where i have recieved nothing for my child.. i feel that isn't fare and i want to know what can i do.. so this doesn't happen every year. i belive i.r.s should have half my ex's refund and i should have also recieved something towards my back childsubport that's owe to me... if you can help me pls let me know..thank you.

They still keep my refund
It's mathematically bullox actually. I have a unpaid student loan totaling 4,700. I've been stuck in dead end jobs my entire life so payment is cutting into other funds such as oh eating ,electricity, and rent. I'm limited on funds to the point this is posted from the library.

My gripe: I owe 4,700 but for over the last 22 years I estimate the IRS has kept a minimum of 13,000+ worth of refunds. This is not including the freebie stimulus checks everyone gets.

The excuse is that the refund is held but the I.R.S. cannot pay the financial institution to who the loan originated from. PFFFFFFFT

It's at the point now I no longer file even though I'm eligible for a full refund year after year.

Child Support
I am one of the rare cases that pays support ( arears only) and I also recieve for my 16 yr old son.
My question is can the I.R.S. take the refund from one case and apply it to the other,ie double dip?
They have already taken my refund for the past due, can they take my youngest sons mothers refund for My outstanding debt?

Can I challenge the 3yr. statue of limitations?
Good Morning, State and federal tax board seem to have a 3yr/2yr statue of limitation on ammending your taxes. Based on some really bad information, I have ended paying taxes since 2004. But on a clue from a friend, I called the tax boards and realized I have been entering information erroneously which has caused me to pay for the last 5 years. I hadn't send my taxes for 09 so I will be able to correct them. Based on the limitations I can ammend 08, 07, 06. But I wanted if anyone could advise me, what my changes would be if I challenged the statute of limitations to get back 05, 04. 2004 is the one I really want, I paid close to 3,000.00 in taxes, when I was owed a 1,900.00 refund.....suggestions, comments??

They took 93% of my fiance's refund
My fiance is default on military loans one is for a laptop and the other is for college. I understand the loan for the laptop because we actually have it but the loan for college doesn't make sense they never held up to their end of the contract. We've tried to call and ask for more time or set up a payment plan to which they responded they wouldn't we had to pay it in full. We've never received bills from the loan offices and didn't get a letter from the irs telling us they siezed the check. And they didn't take it out last year, so we didn't think they would this year. we had plans for that money we have bills to pay, we were relying on this money. I want to know what law or act limits the amount they can take out. Also with the recession were in right now do they not understand how bad off everyone is right now? If the government can bail the banks out why cant they bail the rest of us out? After all the more in debt we are as citizens the worse off the economy is going to be, especially when we can't afford to pay our own bills let alone the loans all of us have!!!! When is the IRS going to do something for me instead of taking every F*CK*ING penny I have left??????????

Unfortunately yes the I.R.S will take your Income tax if you are married and filed taxes together. It's unfortunate that these things happen but they do. Your best bet is to contact the institution handling your husbands student loan and try to put a freeze on it if you cannot afford to pay it at this time. You can tell them that you are not working and want to freeze the loan for a year and when you get back on your feet you will start paying them. the worst thing that almost everyone does when not paying back student loans is doing nothing at all about it. Basically not opening the bills out of embarrasement. it happens to alot of us and it is a tough time. Always try to work out deals with them and as long as you keep your word, your income tax will not be touched. sorry to hear this time and time again especially when we all need the money NOW.. Student Loan
Its very odd. I filed 3 years back taxes last year and had them sent to me via check and they all came. This year I did it direct deposit and the IRS took it. I wonder if Direct Deposit makes a difference? Either way I called the Education Department and set up a payment plan. After 8 monthly payments, I am then put on regular reduced monthly payments and they said they wont take the taxes again. Lesson learned.

unemployment overpayment
I made a very very very stupid mistake a couple years ago. I COLLECTED UNEMPLOYMENT WHILE WORKING. The day the first check arrived I got a new job. I wasn't making much money at this job and two weeks went by and I got the letter stating to call to claim my benefits. So I did. The next check came. I kept doing it like an idiot till all 13000 was drained. A WHOLE YEAR WENT BY AND NOTHING. I THOUGHT I WAS SCOTT FREE. Then I get fired from my job. I go home that day open up the mail and boom there's the letter saying I OWE 16500 with fines. I PUKED ALL OVER MY DRIVE WAY. Long story short I didn't pay them cause I had 0 money to pay them. 3 years later I qualify back for unemployment. GUESS WHAT. THEY TAKE EVERY DOLLAR OF YOUR REFUND UNTIL THE PRINCIPAL IS PAID. I have been home and paid them back all of the principal. it took mE 7 months. AT least they let me pay the principal with my unemployment benefits. I am now finally recieiving money. A BIG ? ALOT HAVE IS WILL UNEMPLOYMENT TAKE MY TAX REFUND. ANSWER IS THEY CAN ONLY TAKE YOUR STATE REFUND. NOT YOUR FEDERAL. IT IS AGAINST THE LAW FOR THEM TO TAKE YOUR FEDERAL TAX RETURN. I've experienced it. A LESSON LEARNED.. I DIDN"T REALLY NEED THE MONEY BACK THEN. NOW I REALLY NEED IT AND IT'S NOT THERE FOR ME BECAUSE OF THE STUPID MISTAKE I MADE. DON;'T DO IT PEOPLE IT WILL COME BACK TO YOU AT THE WORST TIME YOU CAN IMAGINE.. You can find out if the IRS is going to or did keep part or all of your refund by calling the FMS (Financial Management Services) @ 1-800-304-3107, you will need to enter your SS# and the system will give you your info, it also gives you the contact info for who will be taking the money (IRS, child support, student loans, etc.). Deceased grandmother's taxed
The IRS has sent me a bill for my deceased grandmother's taxes for 2002. I was appointed the administrux of her estate after she died in 2006. Am I responsible for something from 2002? The IRS is actually incorrect and we have tried to show them that she in fact filed in 2002 and we even re-filed, but they are still sending me notices and now I am afraid they will keep my refund that I have been expecting.

unpaind traffic tickets
i have some unpaid traffic tickets and the IRS already took my state refund to pay for it..but i want to know can they also take money from my federal refund also if they want?

Child Support and Tax Refunds
The mother of my grandson, whom we have full custody of, is over $10,000 behind in child support. She works a little here and there and recently had another baby. Her mother and step father claimed her AND the baby on their IRS tax return for 2009. Will the IRS know by her social security number that she is in arrearages and take the mother and step fathers refund and apply it towards the back support. I believe she did this so she would not lose her refund to me.

IRS will Not Send A REFUND if you owe Back Taxes
The IRS will take your refund if you owe any back taxes, student loans in Default, or back child support. If you live in a state where there is a State Penalty Tax, and your spouse owes taxes, you will also be held responsible for those amounts owed. Believe Me, I know.... I am currently being penalized for my ex husband, under reporting income of 10,000.00, back in 2003. I havent received any refunds since then, and I am poor as dirt, making under 18K a year.!

You are absolutely right.It is quite hard to pay your tax we save money cutting our expenses and when we get any amount from seizure as tax refund we feel really lucky to use that money for some good purpose.So it is now high time and we need to check this from now.
